What happens when my title search reveals a lien?

Having a title search done when purchasing property in Indian River County can save buyers and sellers from headaches down the road – it’s an investment in the security of your home. Many issues can be discovered and dealt with before closing on a property, and it allows you to step away from the sale if something you are reluctant to have hanging over your head is uncovered.

One of the most common issues is the discovery of judgment liens constituting a title defect. When a lawsuit has been filed, this lien attaches to real property owned by the defending party. If the plaintiff is declared the winner of the court proceeding, the judgment order will be recorded in the county where the case was heard.

At this point, the real property can no longer be freely conveyed without the satisfaction of the lien. If the lien has not been satisfied before the sale of the property, the lien is then conveyed to the new owner – the judgment remains with the property. In Florida, a judgment lien is attached to a property for 10 years and can be extended to 20 years, making it imperative to obtain a title search before closing on any real property to ensure the title is free of any liens.
