What is a title search in Florida?

A title search in Florida includes a chain of title, outstanding liens, and ownership, among other pertinent details about the property. Conducting a title search determines the legal right, mortgage holders, liens, and other encumbrances. The property status impacts whether a property can be sold, gifted, or conveyed with a clear title.

A Florida title search contains seven sections that contain information crucial in the sale or purchase of the property.

Apparent Title Vested In provides information about the current right owner of the property. This section identifies the grantor or property owner’s name.

Description of Real Property is the legal description of where the property is located. This section identifies where the property is recorded: the official records book, page, and county where the property is located. 

Muniments of Title explains the history of ownership regarding the property as it is documented in public records. Each time ownership of a property and title changes, the changes are documented in the county where the property resides and shows any issues that have been involved in litigation regarding the conveyance of the property.

Mortgages, Assignments, and Modifications are identified in this section and include mortgage date, lender, mortgage amount, and public records recording details.

Other Property Liens and Other Encumbrances will be listed here. Language regarding a lien assigns the right to take possession of property belonging to another person until said person has paid the debt, and it has been officially discharged. A lien recorded in the chain of title must be satisfied before selling the property.

Restrictions and Easements An easement allows a third party the legal right to use the land they do not own for an identified purpose. 

Tax Information will be included for the year in question. The title search indicates the ad valorem tax status of the property; whether the taxes have been paid; how much taxes were paid, and the amount of taxes that are due.
